Terms of Service

Effective Date: October 31, 2026

Last Updated: October 31, 2026

Welcome to MigrationPulse. These Terms of Service ("Terms") are a legal agreement between you and MigrationPulse Incorporated, of Fajardo, Puerto Rico, the company that operates MigrationPulse ("MigrationPulse," "we," "us," or "our"). These Terms govern your access to and use of the MigrationPulse platform, including our website, case management tools for immigration offices, client records, the client portal, document collection, translations, e-signature, scheduling and video meetings, and all related services (collectively, the "Service"). By creating an account, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms, our Privacy Policy, our Data Processing Agreement, and any additional terms applicable to specific features you use. If you do not agree, you may not use the Service.

If you are using the Service on behalf of an organization (such as a law office, a recognized organization, or an immigration services business), you represent and warrant that you have authority to bind that organization to these Terms. In these Terms, "your office" means that organization.

2. Eligibility

The Service is for businesses and other organizations that provide immigration services in the United States, including the Commonwealth of Puerto Rico, and for the people who work for them. You must be at least 18 years old to hold an account. By using MigrationPulse, you represent that you meet these requirements and that all information you provide during registration is accurate and complete.

3. Account Registration and Security

You must register for an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Every person who signs in to an office account must use two-step sign-in: after the password, a code from an authenticator app. You agree to notify us immediately at support@migrationpulse.app if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to other users or the platform.

4. Description of Service

MigrationPulse provides software for running an immigration office, including:

  • Case Management: a case for each common immigration filing, with its checklist, dates and current form edition, and forms filled from the case's records for your office to review.
  • Clients, Documents and Translations: client records, document requests and uploads, and translations of documents, which can start from an AI draft.
  • Client Portal: a private page where each client sees what your office has asked for, uploads documents and messages your office.
  • Engagement and E-Signature: contracts, documents and electronic signature workflows between your office and its clients.
  • Scheduling, Meetings and Email: booking calendars, video meetings, and reminders and notices to clients by email.
  • AI Assistance and Training: an assistant that answers immigration questions from cited government sources and helps with drafting, and training courses on the platform.
  • Optional Add-Ons: additional modules may be offered from time to time and are governed by these Terms and any feature-specific terms.

What MigrationPulse is not. MigrationPulse is a software tool. It is not a law firm and is not a substitute for an attorney or an accredited representative. It does not give legal advice, does not represent anyone, and does not file anything with U.S. Citizenship and Immigration Services (USCIS), the Department of State, the Executive Office for Immigration Review or any other government agency. The Service has no online filing step: a case is prepared in it, and your office or your client files it. MigrationPulse is not affiliated with, endorsed by or approved by any government agency.

Form editions, filing fees, processing information and other government information shown in the Service come from official sources as of the date shown with them, and they change. Check them against the agency's current information before you rely on them.

5. Your Role and Your Professional Responsibility

You and your office are solely responsible for the immigration services your office provides, and for:

  • Holding and maintaining the authorization your work requires: an attorney's admission to practice law; a representative's accreditation by the U.S. Department of Justice and the recognition of the organization the representative works for; or, for an office that is neither, staying within what the law of each state where you serve clients allows a non-attorney to do, and meeting that state's registration, bond, contract, notice, sign and advertising rules.
  • Declaring your office's role in the Service truthfully, as an attorney, an accredited representative or a non-attorney form preparer, and keeping that declaration, and any bar or accreditation details in it, current. The Service decides which features to offer from the role you declare, and treats an incomplete or expired declaration as a non-attorney office. You must not offer a client a service your role does not allow, even where the Service would let you record it.
  • Your contracts with, and the notices and disclosures you give to, your own clients, including any your state requires and in any language the law requires. Whether a contract, notice or template meets the law that applies to you is your responsibility, including a template the Service supplies.
  • The accuracy and completeness of every form, translation and document you prepare, and its review by a qualified person before anyone signs it. The Service fills forms only from the records your office keeps, and leaves the forms' questions and every signature to your office and your client.
  • Complying with the federal and state rules that govern immigration services, the unauthorized practice of law, and the advertising of immigration services, including the words you may use to describe yourself and your services.

The Service's role settings, wording checks and templates are tools to help you work within your role. They are not legal advice, and they are not a determination that any service, statement or document is lawful where you work. You must not engage in the unauthorized practice of law.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Collect, upload, use or disclose anyone's identity documents or personal information without the authority, notice and consent the law requires, or in violation of any duty of confidentiality you owe your clients.
  • Send communications to clients or prospects without the consent the law requires, including under the CAN-SPAM Act.
  • Transmit misleading, deceptive, or fraudulent communications.
  • Misrepresent your identity, credentials, role, or authority to provide immigration services, or present yourself as an attorney, an accredited representative, or a person affiliated with any government agency when you are not.
  • Make false or misleading promises about the outcome of any immigration matter.
  • Upload or distribute malware, viruses, or other harmful code.
  • Scrape, harvest, or collect data from the Service through automated means without our written consent.
  • Resell, sublicense, or redistribute the Service or any data obtained through the Service without authorization.
  • Interfere with or disrupt the integrity or performance of the Service.

7. Your Data and Your Clients' Data

Your Data: You retain ownership of all data you upload, create, or generate through the Service, including client records, case records, identity and immigration documents, translations, signatures and communications ("Your Data"). You grant MigrationPulse a limited, non-exclusive license to process Your Data solely to provide, secure and support the Service, as further described in our Privacy Policy and Data Processing Agreement.

Your clients' information: For the personal information of your clients and prospective clients, your office is the controller and MigrationPulse is its processor. Your office decides what it collects and why, is responsible for having the right to collect it and put it in the Service and for any notice or consent the law requires, and answers its clients' requests about it. We process it only on your office's behalf, as the Data Processing Agreement sets out.

Platform Data: MigrationPulse retains ownership of aggregated, de-identified analytics and any proprietary software, models, or features developed as part of the Service.

Export: Your office's owner or a manager can export the account from Settings at any time. What the export contains, and what it does not yet contain, is set out in the Data Processing Agreement; records it does not cover are provided on written request.

When an account ends: its data is not deleted automatically. We keep it, protected as before, so that your office can renew and pick up where it left off or ask us for an export. We delete it when the office's owner asks us to in writing, except data the law requires us to keep and the records our Privacy Policy says are kept for a fixed period.

8. AI, Meetings and Identity Verification

AI-assisted features. The Service includes AI-assisted features, such as the in-app assistant, drafting translations, summarizing meetings your office chooses to transcribe, and drafting messages and documents. The assistant answers immigration questions only from the official government sources it cites, gives the date each was read, and refuses to give legal advice; its answers are labelled as AI-generated. An AI translation is a draft until a person your office names reviews it and certifies exactly that text. AI-generated content is provided for information only and is not legal or professional advice, and you are responsible for reviewing it before you rely on it or give it to a client.

Recording meetings. If your office records or transcribes a video meeting, you are responsible for telling everyone in it and for obtaining any consent the law requires. The Service shows the people in the meeting that recording has started, but it does not ask for or record anyone's consent.

Identity verification. The Service lets your office record an identity check it does in person, or send a client a link to a remote check that compares a photo ID with a selfie. Your office is responsible for deciding when to verify a client, for telling the client how their information and images will be used, and for any consent the law requires, including for comparing a face with an ID. Remote checks are carried out by an identity verification provider and are charged as usage charges. A completed check's record is kept for the fixed period our Privacy Policy describes and cannot be deleted before it ends.

9. Payment and Billing

Certain features require a paid plan. The plans and their prices are shown on our pricing page and again before you pay, and by buying a plan you agree to pay the fee shown. Usage charges are taken from your account's prepaid balance at the rates on our Usage Charges page, which forms part of these Terms. See our Billing & Refund Policy for how plan terms, renewal, refunds, and cancellation work.

10. Beta Access

The Service may be offered on a pre-release or beta basis. Beta features are provided "as is," may change or be withdrawn at any time, and may contain errors. We may invite you to provide feedback; any feedback you provide may be used by MigrationPulse without restriction.

11. Intellectual Property

The Service, including all software, design, text, graphics, logos, and trademarks, is owned by MigrationPulse Incorporated or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

12. Third-Party Services

The Service relies on third-party providers to operate, including infrastructure and hosting, payment processing, email delivery, identity verification, video meeting and AI providers. Your use of any third-party service you connect yourself is subject to that provider's terms. Except as Section 13 provides, MigrationPulse is not responsible for the availability, accuracy, or practices of third-party services.

13. Service Level Commitment

MigrationPulse commits to a Monthly Uptime Percentage of at least 99.9% for every paid plan. Availability is monitored continuously and independently, and the measured figure is published at migrationpulse.app/status.

"Monthly Uptime Percentage" means the percentage of a calendar month during which the Service was available, as recorded by our monitoring. "Monthly Fee" means one twelfth of your annual plan fee, or your monthly fee if you are billed monthly.

If the Monthly Uptime Percentage falls below 99.9% in a calendar month, you may claim a service credit:

  • Below 99.9% and at or above 99.0%: a credit of 10% of the Monthly Fee.
  • Below 99.0% and at or above 95.0%: a credit of 25% of the Monthly Fee.
  • Below 95.0%: a credit of 50% of the Monthly Fee.

To claim a credit, contact us in writing within thirty (30) days of the end of the affected month. Credits are applied to your account against future fees, are not redeemable for cash, and will not exceed the Monthly Fee for the affected month.

Exclusions. This commitment does not cover unavailability caused by: (a) scheduled maintenance for which we gave at least forty-eight (48) hours' notice; (b) your own network, equipment, software, or acts and omissions; (c) suspension or termination of your account for non-payment or breach of these Terms under Section 17; or (d) events outside our reasonable control as described in Section 24.

What is not excluded. Failures of our hosting, database, or other infrastructure providers count against this commitment. We chose those providers and you contracted with us, so their outages are ours to answer for.

Service credits are your sole and exclusive remedy for any failure to meet this commitment.

14. Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED IN SECTION 13 (SERVICE LEVEL COMMITMENT), THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT ANY FORM, TRANSLATION, OR AI OUTPUT IS CORRECT WITHOUT REVIEW BY A QUALIFIED PERSON, THAT ANY FORM EDITION, FEE, OR DATE SHOWN IS CURRENT, OR THAT ANY GOVERNMENT AGENCY WILL ACCEPT OR APPROVE ANY CASE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIGRATIONPULSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO MIGRATIONPULSE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

16. Indemnification

You agree to indemnify, defend, and hold harmless MigrationPulse and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, the immigration services your office provides (including any claim that a service was the unauthorized practice of law), your violation of these Terms, or your violation of any applicable law or professional obligation.

17. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Upon termination, your right to use the Service ceases immediately, but Sections 7, 11, 13 to 15, and 17 to 23 shall survive.

18. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to its conflict of laws principles. Any disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, seated in Puerto Rico. You agree to waive any right to a jury trial or to participate in a class action.

19. Changes to Terms

We may modify these Terms at any time by posting the updated version on our website. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

20. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

21. Entire Agreement

These Terms, together with the Privacy Policy, Billing & Refund Policy, Usage Charges, and Data Processing Agreement, constitute the entire agreement between you and MigrationPulse regarding the Service and supersede all prior agreements and communications, whether written or oral.

22. Waiver

The failure of MigrationPulse to enforce any right or provision of these Terms shall not constitute a waiver. Any waiver must be in writing and signed by MigrationPulse to be effective.

23. Assignment

You may not assign or transfer these Terms without our prior written consent. MigrationPulse may assign these Terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of its assets without your consent.

24. Force Majeure

MigrationPulse shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including natural disasters, acts of war or terrorism, epidemics, government actions, power failures, internet disruptions, or third-party provider outages. For the commitment in Section 13, failures of our hosting, database, or other infrastructure providers are not treated as causes beyond our reasonable control.
